James McCann’s practice encompasses the areas of acquisition, sale and development of real property, land use, redevelopment law, tax abatements, condominium and planned real estate development law, and alcoholic beverage licensing, transfers and regulatory compliance.

Jim has been a real estate practitioner in Jersey City for over 25 years, handling complex land use and permitting matters. He has extensive experience in the representation of developers before municipalities, redevelopment agencies and planning boards in redevelopment areas established under New Jersey’s Local Redevelopment and Housing Law. He focuses on the negotiation of tax abatement agreements with municipalities under New Jersey’s Long Term Tax Exemption Law and other tax abatement statutes. Jim has assisted in the drafting of numerous redevelopment plans and, through his representation of the development community, has influenced redevelopment and tax abatement policy in Jersey City.

His experience extends to the representation of developers in the New Jersey Superior Court, Law Division, Chancery Division and Appellate Division on litigated approvals under the Municipal Land Use Law, Local Redevelopment and Housing Law, and New Jersey’s Long Term Tax Exemption Law. Jim has prepared and registered numerous applications for registration of public offering statements with the New Jersey Department of Community Affairs for mixed-use and high-rise condominium buildings. He has substantial experience representing developers and restaurateurs in alcoholic beverage licensing, liquor license transfers and regulatory compliance.

Representative clients range from large nationally known development companies to regional and small real estate developers, many of whom have developed notable projects contributing to Jersey City’s real estate renaissance.

Jim has lectured for the New Jersey Institute for Continuing Legal Education and the New Jersey State Bar Association on the Long Term Tax Exemption Law and the Local Redevelopment and Housing Law.

  • General development counsel to the Lefrak Organization in connection with “Newport,” a 600-acre master planned, mixed-use community located on the Hudson River waterfront in Jersey City, New Jersey, currently consisting of 10 high-rise rental apartment buildings, three high-rise condominium buildings, eight high-rise office towers, two hotels, and thousands of square feet of retail, office and entertainment facilities.
  • General development counsel to Toll Bros, Inc. in connection with 10 Provost Square, a planned high-rise mixed-use condominium with up to 900 residential units, 50,000 square feet of retail space and a performing arts center in Jersey City’s Powerhouse Arts Redevelopment District.
  • Land use counsel to The KRE Group in connection with Journal Squared — a mixed use project containing retail space with 1,800 residential units in three towers ranging in height from 54 stories to 70 stories in the Journal Redevelopment Plan Area.  
  • General development counsel for “Liberty Harbor,” an 80-acre master planned mixed-use community in Jersey City currently consisting of residential town home-style and high-rise condominiums, luxury rental units in three high-rise buildings, with retail, office and entertainment facilities.
  • General development counsel to Fisher Development Associates, LLC in connection with Park Avenue, a mixed use project containing retail space with 900 residential units in two 45-story towers in the Liberty Harbor North Redevelopment Plan Area.  
  • General development counsel to Fields Development Company in connection with the development of 197-207 Van Vorst Street, a mixed-use rental complex in two 15-story towers with 663 units in the Tidelands Basin Redevelopment Area.

About The Governor

Honorable Phil Murphy
Governor

Phil Murphy, as he says, “grew up in a family that was middle class on a good day.” That has shaped Phil’s values, his priorities, and the kind of governor he will be.

Religion, basic values, work ethic, education, and civic awareness were pillars of family life. His father never graduated from high school, his mother worked as a secretary; they inspired Phil and his three siblings to pursue their educations and be active participants in civic life.

Phil put himself through Harvard on loans and part-time jobs. After earning a graduate degree at the Wharton School at the University of Pennsylvania, he started his career at the bottom, working his way up to help lead a major international business by learning how economies grow and create jobs.

Phil has helped lead local charities to support troubled teens and domestic abuse survivors, and these groups have changed thousands of lives for the better. Nationally, Phil served proudly as New Jersey’s sole representative on the board of the NAACP, the world’s oldest civil rights organization. He served as Finance Chair of the Democratic National Committee, helping Howard Dean on the “Fifty-State Strategy” that rebuilt the Democratic Party from the grassroots up; that effort helped return Congress to Democratic hands in 2006 and elect President Barack Obama in 2008. Phil also has led national and state task forces on education and public employee pensions and benefits.

In 2009, Phil answered President Obama’s call to service and became the U.S. Ambassador to Germany after his confirmation by the U.S. Senate. After returning home in 2013, Phil and his wife, Tammy, saw our state falling behind. They couldn’t sit by and watch hard working families struggling to stay even, much less get ahead. They founded New Start New Jersey as a “think and do” organization to rebuild the state’s economy from the middle class out — New Start New Jersey partnered with the Heldrich Center for Workforce Development at Rutgers University to create the New Start Career Network, which is helping older, long-term unemployed residents once again actively compete for good jobs.

As governor, Phil will make New Jersey more fair and just for all residents. His vision would grow the middle class and jumpstart the state’s economy by targeting investments in people and infrastructure, reclaiming New Jersey’s mantle as a center of the STEM and innovation economies, protecting working families by raising the minimum wage and expanding earned sick leave for all, and protecting the middle class with real tax fairness.

Phil and Tammy live in Monmouth County and are the parents of Josh, Emma, Charlie, and Sam.

Key Initiatives in Jersey City & Across NJ

Economy & Jobs

Governor Murphy’s primary focus is building a stronger and fairer economy that works for every New Jersey family. Since the recession, incomes have been stagnant while costs of living continue to rise, making it difficult for middle-class and working-class families to get by, much less get ahead. Governor Murphy believes in strengthening our economy by reigniting the innovation economy that made New Jersey the Silicon Valley before there was a Silicon Valley, and investing in infrastructure to take advantage of our location between two major markets. He is committed to making New Jersey’s economy fairer by raising the minimum wage to $15 an hour, expanding protections for workers such as paid sick leave, and providing tax relief to working families. Governor Murphy will also institute a renewed focus on workforce development, vocational training, and apprenticeship programs so that workers will have the skills they need to meet employers’ requirements.

Education

Our state’s economic future depends on giving our children the education they need to succeed in a 21st-century economy where they will be competing with workers around the globe. While New Jersey is blessed with some of the best public schools and educators in the nation, significant disparities exist within our educational system. Governor Murphy is committed to fully funding the existing school funding formula, which was held up as a national model when passed, and opposes the unnecessary usage of standardized tests, particularly as graduation requirements. And money should never be a barrier to students who have the ability and drive to go to college, which is why he will work towards making community college free and four-year college more affordable.

Environment

Governor Murphy recognizes that climate change is a fact and an existential threat to our state and that the effects are already being felt along our shoreline. While this is a crisis to be addressed, it is also an opportunity to build a clean energy economy with good-paying green jobs. Governor Murphy will seize this opportunity by restoring New Jersey’s participation in the Regional Greenhouse Gas Initiative and putting New Jersey on a road to 100 percent clean energy by 2050. He will accelerate the development of renewable energy sources by promoting solar energy and jumpstarting our offshore wind industry, where New Jersey should be a national leader given its location. In addition, he will ensure that our environmental efforts are appropriately focused on low-income communities who are disproportionately impacted by pollution, and protect the quality of our air and water supply.

Health

Governor Murphy believes that health care is a right, not a privilege, and will work to ensure that all New Jerseyans have access to affordable health care. The Affordable Care Act was a huge step in the right direction and reduced the uninsured population in the state by hundreds of thousands, and Governor Murphy will defend it against all attacks in Washington. He will fight back against any attempts to slash Medicaid funding or end the Children’s Health Insurance Program, which are crucial to many New Jerseyans. And Governor Murphy is committed to taking action at the state level to make health care more affordable and accessible.

Law & Justice

New Jersey has the shameful distinction of having the largest black-white incarceration gap of any state in the country. Governor Murphy will address this problem by bringing law enforcement and the community together, as he did when he brokered the first meeting between the head of the state PBA and the state chapter of the NAACP. He will end mass incarceration by pursuing the legalization of marijuana and comprehensively reviewing all criminal sentencing laws. Governor Murphy will also ensure that all of our communities are safe. That includes defending our immigrant communities that are being targeted by the federal government by ensuring that all New Jersey residents facing detention or deportation have access to legal representation. And he will also sign common-sense gun safety measures in order to stem the epidemic of gun violence that plagues our state.

Transportation

One of New Jersey’s greatest assets is its location, with access to two of the largest markets in the world. However, our state has squandered this advantage due to a failure to make the necessary investments in its infrastructure. The two current rail tunnels under the Hudson River are over 100 years old and rapidly deteriorating. After the termination of the Access to the Region’s Core project, which would have resulted in the opening of two new tunnels this year, Governor Murphy understands that the replacement Gateway Project is essential and will do everything possible to support it. Additionally, NJTransit has suffered from severe underfunding and mismanagement, which has seen fares soar while the quality of service and safety has declined sharply. Governor Murphy is committed to turning NJTransit around by ensuring that funding is adequate, improving customer service, and putting transportation experts in charge.

Steven Michael Fulop is the 49th and current Mayor of Jersey City, New Jersey – named the most diverse city in the nation and the soon-to-be largest city in New Jersey.

Since Mayor Fulop took office in 2013, Jersey City residents have seen four consecutive years of stable taxes and four consecutive credit rating upgrades. Meanwhile, more than 300 new police officers have been hired, nearly 1,500 units of affordable housing built or approved, recreation expanded with nearly 30 new programs, and more than $6 million invested in parks and open space.

During his time in office, Mayor Fulop has shown what smart, progressive leadership can accomplish – and opened a new chapter for Jersey City.

Under his leadership, Jersey City became the first city in the state – and the 6th city in the country – to ensure paid sick leave. Mayor Fulop has pioneered new ideas for helping prisoners re-enter society; he’s passed legislation to protect small businesses and encouraged more to open shop; made Jersey City one of the greenest cities in the nation. He’s undertaken sweeping public safety reform, with the JCPD now seen as a model for diversity around the nation. And Mayor Fulop has led the city to record economic development that’s benefited families of all income levels. All without raising taxes.

Mayor Fulop is a first-generation American, a lifelong New Jerseyan, a Marine, and a triathlete. He grew up in a Jewish family in Edison, New Jersey, the son of Romanian immigrants. His mother was the daughter of Holocaust survivors and worked in an immigration services office helping others gain citizenship. His father owned a delicatessen nearby in Newark, where Mayor Fulop worked behind the counter as a teenager.

Mayor Fulop graduated from Binghamton University in 1999 and spent time abroad studying at Oxford University in the UK. After college, he joined Goldman Sachs, the investment banking firm, working in Chicago and later in Manhattan and Jersey City. On the morning of September 11, 2001, Mayor Fulop was working in lower Manhattan when he saw the first plane strike the Twin Towers. A few weeks later, he decided to put his career at Goldman Sachs on hold and join the United States Marine Corps.

Mayor Fulop’s Reserve Unit deployed to Iraq in January 2003. There, he served as part of the 6th Engineer Support Battalion. He traveled into Baghdad during the early weeks of the war. In 2006, Mayor Fulop completed his service to the Marine Corps Reserve with the rank of Corporal.

In 2005, Mayor Fulop was first elected to public office as the councilman representing downtown Jersey City. He served as a councilman for eight years before becoming Mayor.

Mayor Fulop is an avid runner and triathlete. He ran the NYC Marathon in 2012, raising money for the Hudson County Child Abuse Prevention Center. He also competed in the Ironman Championship in NYC that year to raise money for veterans.

He also advised Merrill Lynch & Co. in the restructuring of mixed use residential/commercial developments in Charlestown, Massachusetts; Alexandria, Virginia; and Waco, Texas.

Phil also represented the Shell Oil Company in the negotiation and disposition of over 350 service stations throughout the tri-state area. He has participated as underwriter’s counsel and corporate trust counsel in New Jersey State and other municipal financings totaling more than several billion dollars in value. He has negotiated leases on behalf of landlords and tenants for commercial structures in excess of 5,000,000 square feet.

Joseph A. Panepinto, Sr. is Founder and President of Panepinto Properties, Inc. and has

spearheaded a renaissance in Jersey City, the city to which he has dedicated his professional

career and his passion. He served as Jersey City Planning Board Attorney (1971-73), and later as

Paul Hoffman, the President and CEO of Liberty Science Center, is leading a transformative era at LSC. As a journalist and biographer, Hoffman’s extensive body of work explores the relationship between genius, madness, obsession and creativity. He is a noted expert on the public understanding of science, and has advised NASA, the National Science Foundation, the National Academy of Engineering, the American Association for the Advancement of Science, and the Institute of Electrical and Electronics Engineers. Hoffman, who was elected to the American Academy of Arts and Sciences, graduated summa cum laude and Phi Beta Kappa from Harvard College.

As Associate Director of Planning Services, much of Charles’ work at Dresdner Robin is focused on the key components of land use and environmental planning. He places a strong emphasis on development feasibility, redevelopment, environmental and fiscal impact analysis, and sustainability. His skillset includes development feasibility, community engagement, environmental/fiscal impact analysis, and population/planning/variance studies. Because of his wide base of experience in residential, commercial, mixed-use, industrial, and institutional projects, Charles demonstrates a facility with effective project management. He is often called upon as an expert witness in planning before local and regional boards throughout the tri-state area. Before joining Dresdner Robin, Charles was a key contributor to the early development of the Sustainable Jersey certification program with the Sustainability Institute (formerly New Jersey Sustainable State Institute). He continues to collaborate on various projects with the Center for Urban Policy Research, including the annual National Historic Preservation Tax Credit Report. Jersey City is moving forward with development of its west side, along the Hackensack River. The project is one of the largest redevelopment projects and includes 95 acres of land that has been remediated and is controlled by the City.

Government Leaders have considered multiple options for “Bayfront”, which is located adjacent to Society Hill on Route 440.

Up to 8,000 residential units are proposed with Mayor Fulop supporting affordable housing that will be located on site. Throughout his career, Mr. Baker has represented small to middle-market businesses, publicly-traded companies, private equity firms, real estate investment companies, and mortgage investors and servicers, all with diversified real estate holdings and needs. He routinely negotiates and drafts a wide variety of commercial leases, ranging from large-scale retail and office leases to single-tenant industrial facilities on behalf of both landlords and tenants. In addition, he advises clients in sale/leaseback transactions and is regularly retained as local counsel to out-of-state firms to offer assistance and guidance in the sale, purchase, and leasing of commercial real estate assets in New Jersey.

Joyce has been a volunteer Chaplin for over 30 years at Eastern State Prison and 8 years at Clinton State Prison. development group is currently in approvals and design for an 800-unit mixed use development project in Jersey City, NJ. The solar company is a fully integrated solar developer that has
executed over $500 million of projects on the east coast.

Prior to G&S, Abe Naparstek was an Executive Vice President, managing new development activities in Boston, New York, and Washington D.C. for Brookfield Properties. In that capacity Abe managed a team of developers responsible for a pipeline of over $10 billion of mixed-use development. These projects are principally in New York City, Jersey City, Philadelphia, and the Washington D.C. metro area. Prior to this position, Abe was a Senior Vice President at Forest City Enterprises, where he started in 2004. Prior to Forest City, Abe was the Assistant County Manager of Allegheny County in Pennsylvania. In that capacity, he worked on a number of policy initiatives for the County with a primary focus and responsibility in economic development and government relations. Abe was the primary interface with the County’s eight regional government entities and helped implement Tax Increment Funding packages for development projects that totaled over $250 million. Abe also represented the County Executive at County Council and with the state and federal legislative delegations. Abe is on the board of directors of Neighbors Together, a social service non-profit in central Brooklyn. Brothers serves first-time, move-up, empty-nester, active-adult and second-home buyers, as well as

renters, in suburban and urban markets in 24 states across the U.S. and Washington, D.C. In 2023,

Fortune magazine named Toll Brothers the World’s Most Admired Homebuilder, the eighth year it has

been so honored.

 

Fred Cooper joined Toll Brothers in 1993 to establish its Finance and Investor Relations Departments. As

the firm’s in-house investment bank, the team he leads is responsible for Toll’s capital markets and

investor relations activities, its ESG and financial planning initiatives, and its partnering relationships

with major U.S. and international financial and development institutions. Since formation, the group has

raised over $25 billion from U.S., European and Asian banks, the public capital markets, and U.S. and

International institutional partners. In addition to capital raising, they advise on complex project

structuring, joint ventures, corporate mergers and acquisitions and major property acquisitions.

 

Fred has been financial point for Toll’s expansion into the urban high-rise condo business through Toll

Brothers City Living, which has grown into an operation of over 45 buildings and 5,500 units, primarily in

the metro-NYC area.  He also has been financial point for Toll’s expansion into the rental apartment

business through Toll Brothers Apartment Living (TBAL), which has grown to become the 11 th largest

apartment developer in the U.S. and now controls $3 billion in assets in a pipeline of completed and in-

development projects totaling over 20,000 units. He also has overseen Toll Brothers’ development of

international relationships in Europe, Asia, Latin America, and the Middle East.

 

From 1989 to 1993, Fred was Director of Corporate Finance and Planning at DKM Properties Corp., the

real estate arm of a Forbes Private 50 company and of the nation’s largest private companies. From

1984 to 1989, he was Senior Vice President and a member of the Executive Committee of the NYC

Financial Services Corporation, (now NYC Economic Development Corporation.), New York City’s

economic development bank. From 1980 to 1983 he worked in community-based affordable housing

and economic development in the South Bronx and Brooklyn, New York.

 

He holds an A.B. from Brown University and a Master of Public Policy in finance and international

development from Harvard University’s Kennedy School of Government.
